End User License Agreement

This agreement is between you and Nita Media and Publishing, LLC (“Nita Media”) and governs your use of software we distribute directly from nitamedia.com (the “Software”) — today, Lumina for macOS. By installing or using the Software, you accept this agreement.
What this agreement does not cover
Products we sell through someone else's store come with that store's terms, not these:
- Mobile apps obtained from the Apple App Store are licensed under Apple's Licensed Application End User License Agreement, part of the Apple Media Services Terms and Conditions. Apps obtained from Google Play are licensed under the Google Play Terms of Service. Where we supply our own end user license terms in a store listing, those terms apply to that app.
- Books purchased from Amazon are governed by Amazon's Conditions of Use and, for ebooks, the Kindle Store Terms of Use.
1. License
We grant you a personal, non-exclusive, non-transferable license to install and use the Software on Macs that you own or control, for personal or internal business use. The Software is licensed, not sold; we retain all rights not expressly granted.
2. Free and paid content
Lumina is free to download, and the screensavers and overlays included in a given release may be free or may require a paid pass.
The Lumina Update Pass unlocks every screensaver and overlay available at the time of purchase, plus content released during your pass term. When a pass lapses, you keep everything that was released during your term — content released after that date requires a renewal. A lapsed pass never removes access to content you already unlocked.
A license key may be activated on a limited number of Macs. You may deactivate a Mac to free an activation; doing so removes Update Pass content from that Mac, and you can activate it again at any time. The free screensavers and overlays are unaffected either way.
If a purchase is refunded or charged back, the license key is deactivated and the paid content locks again. Lumina itself keeps working — the free screensavers and overlays are never disabled.
3. What you may not do
- Copy, distribute, sell, rent, sublicense, or make the Software available to others, except as this agreement allows.
- Reverse engineer, decompile, or disassemble the Software, except where that restriction is prohibited by law.
- Circumvent, disable, or interfere with licensing, entitlement, or update mechanisms; or share, resell, or publish license keys.
- Remove or alter any copyright, trademark, or other proprietary notices.
4. Updates
The Software may check for and install updates. Updates are covered by this agreement unless they are accompanied by separate terms. We may change, suspend, or discontinue any part of the Software at any time.
5. Privacy
Our handling of information is described in our Privacy Policy, which forms part of this agreement.
6. Ownership
The Software, including its artwork, animations, shaders, and other content, is owned by Nita Media and protected by copyright and other laws. Third-party components included in the Software remain subject to their own licenses.
7. Disclaimer of warranties
THE SOFTWARE IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Software will be uninterrupted or error-free.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NITA MEDIA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR REVENUE. Our total liability arising out of or relating to the Software will not exceed the amount you paid us for it in the twelve months preceding the claim.
Some jurisdictions do not allow certain exclusions or limitations, so parts of the two sections above may not apply to you. Nothing in this agreement limits your statutory consumer rights.
9. Termination
This license ends automatically if you breach it. On termination you must stop using the Software and remove it from your Macs. You may end this agreement at any time by uninstalling the Software.
10. Governing law
This agreement is governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules, and without limiting any mandatory consumer protections available to you where you live.
